SELAH Terms of Service

These Terms of Service ("Terms") govern your access to and use of SELAH, a mobile application provided by Elevate Management Solutions LLC ("we," "us," or "our").

By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old (or 16 in the EU/UK, or older as your local law requires) to use SELAH. By using the App, you represent that you meet this requirement.

If you're using SELAH on behalf of an organization (e.g., a church or ministry licensing the App for members), you represent that you have authority to bind that organization to these Terms.

2. Your account

To use most features of SELAH, you'll need to create an account using email/password, Google, or Apple Sign In.

You are responsible for:

• Keeping your login credentials secure
• All activity that happens under your account
• Notifying us promptly if you believe your account has been compromised (email support@selahmeditationapp.com)

You may not:

• Share your account with others
• Create accounts using false information
• Have multiple accounts to abuse free trials or subscription pricing

We may suspend or terminate accounts that violate these Terms.

3. Subscriptions

3.1 Free tier and Pro tier

SELAH offers a free tier with access to the audio Bible (full coverage), selected playlists, and limited ambient tracks. Upgrade to Pro to unlock the full library, custom playlist creation, offline downloads, multiple voices for playlist narration, and other features. Specific feature splits may change over time.

3.2 Pricing

Subscription prices are displayed in the App at the time of purchase. Prices vary by country and are set in your local currency where Apple and Google support it. We may change subscription prices, with notice, for future renewals.

3.3 Free trial

Pro subscriptions may include a free trial period (typically 7 days). You will not be charged during the trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the subscription price.

3.4 Auto-renewal

Subscriptions auto-renew at the end of each billing period (monthly or annually) until you cancel. The renewal charge is processed by Apple (iOS) or Google (Android) using your default payment method.

3.5 Cancellation

To cancel a subscription:

• iOS: open Settings → tap your name → Subscriptions → SELAH → Cancel
• Android: open Google Play → Account → Subscriptions → SELAH → Cancel

Cancellation takes effect at the end of your current billing period. You'll retain Pro access until then.

3.6 Refunds

All refund requests are handled by Apple or Google, not by us. To request a refund:

• iOS: visit https://reportaproblem.apple.com
• Android: visit https://play.google.com/store/account

We may issue refunds at our discretion in cases of provable error or billing failure. Email support@selahmeditationapp.com.

4. Acceptable use

You agree NOT to:

• Reverse-engineer, decompile, or attempt to extract source code from the App
• Use the App to violate any law
• Distribute audio content from the App outside the App (e.g., extracting narration MP3s and uploading elsewhere)
• Attempt to circumvent paywalls, free trial restrictions, or subscription status enforcement
• Use the App to harass, harm, or impersonate others
• Submit feedback or content that is unlawful, hateful, or infringes someone else's rights
• Resell, sublicense, or commercially redistribute access to the App (church licensing arrangements are an exception — contact us for that)
• Use automated means (scrapers, bots) to access the App's content
• Burden our servers with excessive automated requests

We may suspend or terminate accounts that violate these rules.

5. Content and intellectual property

5.1 Scripture content

The Bible text used in SELAH is the King James Version, which is in the public domain in most jurisdictions. Some jurisdictions (notably the United Kingdom) have unique restrictions on KJV reproduction; we comply with those requirements where applicable.

Other Bible translations may be added in the future under license. Such translations may be subject to additional terms.

5.2 Audio narration and ambient music

Audio narration is generated using AI text-to-speech technology (ElevenLabs). The narration files are owned by Elevate Management Solutions LLC and licensed to you for personal, non-commercial use within the App.

Ambient music tracks are licensed under Creative Commons (CC0) or similar terms from sources like Pixabay Music. Attribution is provided in the App where required.

5.3 Your content

You retain ownership of any content you create within SELAH (e.g., custom playlists, bookmarks). You grant us a limited, worldwide, royalty-free license to store, display, and process this content solely to operate the App and provide you with the service.

You can export your content (data portability) by emailing support@selahmeditationapp.com.

5.4 Trademark

"SELAH," the SELAH logo, and all related marks are trademarks of Elevate Management Solutions LLC. You may not use them without written permission.

6. Disclaimers

SELAH is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.1 Spiritual / religious disclaimer

SELAH is a tool for personal scripture meditation and prayer. It is not a substitute for pastoral care, professional spiritual direction, or membership in a faith community. We make no representation about the theological accuracy of any commentary, playlist curation, or program content provided in the App.

6.2 Mental health disclaimer

If you are experiencing a mental health crisis, suicidal thoughts, or other emergency, please contact qualified emergency services or a mental health professional. SELAH is not designed for crisis intervention.

6.3 Service availability

We do not guarantee uninterrupted access. The App may be unavailable during maintenance, due to issues with third-party services (Apple, Google, Supabase, etc.), or for other reasons. We will make reasonable effort to communicate prolonged outages.

7. Limitation of liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim related to the App is limited to the amount you paid us in the 12 months preceding the claim, or USD $50, whichever is greater
• We are not liable for issues caused by third-party services (Apple, Google, Supabase, ElevenLabs, RevenueCat, Sentry)

Some jurisdictions don't allow these limitations; in such cases, our liability is limited to the maximum extent permitted by law.

8. Indemnification

You agree to defend and indemnify us against any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your misuse of the App
• Content you submit (feedback, custom playlists, etc.) that infringes someone's rights

9. Changes to the App

We may add, remove, or change features at any time. We may also discontinue the App entirely with reasonable notice (typically 30 days for paying users).

If we discontinue, we will refund any prepaid subscription periods that haven't been used.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified via in-app notice or email. Continued use of the App after a change means you accept the updated Terms.

If you don't agree with a change, you can cancel your subscription and stop using the App.

11. Termination

You can stop using SELAH at any time. To delete your account, email support@selahmeditationapp.com.

We may suspend or terminate your account if:

• You violate these Terms
• We're required to by law
• We discontinue the App

If we terminate without cause (i.e., not because of a violation by you), we'll refund the unused portion of your prepaid subscription.

12. Governing law and disputes

These Terms are governed by the laws of [STATE — fill in based on where Elevate Management Solutions LLC is registered], United States, without regard to conflict-of-law principles.

For disputes:

• We encourage informal resolution first — email support@selahmeditationapp.com
• If informal resolution fails, disputes are subject to binding arbitration in [JURISDICTION], administered by [ARBITRATION PROVIDER, e.g., AAA or JAMS], except for claims you may bring in small claims court
• You waive the right to a jury trial and to participate in class actions, to the extent permitted by law

EU/UK consumers have the right to bring claims in their local courts; nothing in this section overrides those rights.

13. Apple-specific terms (iOS users)

If you downloaded SELAH from the Apple App Store, the following applies:

• These Terms are between you and us, not between you and Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support for SELAH
• In the event of any failure to conform to a warranty, Apple may refund the App's price, and to the maximum extent permitted by law, has no other warranty obligation
• Apple is a third-party beneficiary of these Terms and may enforce them
• You confirm you are not in a country embargoed by the U.S. government and not on a U.S. government list of prohibited or restricted parties

14. Miscellaneous

• Entire agreement: these Terms (plus the Privacy Policy) are the entire agreement between us.
• Severability: if any provision is unenforceable, the rest remains in effect.
• No waiver: our failure to enforce a term doesn't waive our right to enforce it later.
• Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
